Terms of Service

1. Acceptance of Terms

By using the Estimonia website (estimonia.com) or the Estimonia mobile application (together, the "App" or the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and Reaktör Teknoloji Tic. Ltd. Şti. (trading as "Estimonia"), Şahkulu Mah. Serdar-ı Ekrem Cad. No:15/A, Beyoğlu/İstanbul 34430, Türkiye ("Estimonia", "we", "us").

2. Eligibility and Age Requirements

You must be at least 13 years old to use Estimonia. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent and warrant that you meet these age requirements.

3. Service Description

Estimonia provides AI-powered value estimates for personal items including watches, jewelry, antiques, collectibles, art, and other valuables. Our service uses artificial intelligence and machine learning algorithms to analyze images you provide and generate an estimated value range, a confidence score and an explanation, based on what the model identifies in the photos and what similar items typically sell for. Estimonia is an independent service: it is built on third-party AI models and is not affiliated with, endorsed by or sponsored by the companies that make them.

Third-Party AI Processing: To generate value estimates, your item photos are sent to third-party AI service providers (such as OpenAI, Anthropic, and Google Gemini) for analysis. Only your photos and analysis instructions are shared with these providers — no personal information (name, email, device ID) is included. Before your first scan, the app will ask for your explicit consent to this data processing. See our Privacy Policy for full details on what data is sent, to whom, and how it is protected.

4. No Guarantee of Accuracy

While we strive to provide helpful and reasonable estimates, we make NO WARRANTY regarding the accuracy, completeness, reliability, timeliness, or suitability of any estimate provided through the App. You acknowledge and agree that:

• AI estimates may be incorrect, incomplete, or outdated
• Actual market values can vary significantly from our estimates
• Estimates do not account for condition nuances, authenticity, provenance, or market timing
• Professional appraisers, dealers, and auction houses may provide different valuations
• You should consult qualified professionals for important decisions involving valuable items

5. User Account and Responsibilities

You may use Estimonia anonymously or create an optional account. If you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You also agree that you will:

• Own or have permission to photograph and submit items you scan
• Not upload inappropriate, illegal, offensive, or infringing content
• Not use the App for any unlawful purpose or in violation of these Terms
• Not attempt to reverse engineer, hack, or circumvent the App's security
• Not use automated tools (bots, scrapers) to access the App without permission
• Not impersonate others or misrepresent your affiliation with any person or entity

6. Selling Opt-In, Partner Introductions and Referral Fees

If you choose to express interest in selling an item, you are asking us to help you find a buyer. We will only ever contact you about items you have explicitly submitted for sale consideration.

6.1 What we share, and when. Where you have separately ticked the sharing consent box, we may pass your name, email address, phone number (if given), item photographs, AI valuation, category, country, postal area and stated selling timeline to a small number of auction houses and dealers whose specialties match your item. We do not share your details with any partner unless that specific consent is on record for you. Ticking the sharing box is optional and is never a condition of using the valuation tool. That same consent also allows us to feature the item itself — photographs, description and value range, never your contact details — in the email digests and the members' dashboard used by vetted professional buyers and dealers.

6.1a Trade visibility (anonymous). Separately from 6.1, you may tick a box on your valuation result to let vetted auction houses and dealers see that item in the members' dashboard. This is deliberately narrower than 6.1: they see the photographs, the AI estimate, the category, the country the item was shared from, and — only if you choose to type one into the optional field next to that box — the town. They do not see your name, email address, phone number or postal code. Leaving the town blank is always an option and changes nothing else; members then see the country alone. If a member asks to be introduced, we come to you first and nothing is exchanged unless you agree. You can withdraw this at any time under 6.4, and the item stops being shown.

6.1b Valuations we check first. Our valuations are generated automatically and are occasionally wrong by a wide margin. Where an estimate is unusually high we record your consent under 6.1a but hold the item back until someone here has reviewed it, so we may not show it to members immediately, and we may decide not to show it at all. Your consent is unaffected either way, and you can withdraw it at any time whether or not the item has been shown.

6.2 How we are paid. Auction houses and dealers may pay Estimonia a flat monthly or yearly membership fee for access to our trade dashboard, or for featured placement and verified status in our directory. The valuation tool is free, and nothing anyone pays us changes your valuation, the estimated value range, or which businesses we consider a match for your item. Optional paid products for individuals are described in section 6B; buying one never changes an estimate either. We do not charge auction houses per introduction. Where we link to a marketplace or auction platform as somewhere you might sell, we may earn a commission from that platform if you go on to sell there — from them, never from you, and it does not change which platforms we suggest or what we tell you an item is worth. Such links are marked. Matching is based on item category and location only.

6.3 We are not a party to your sale. Estimonia introduces you to a potential buyer or consignee; we do not act as your agent, broker, appraiser or auctioneer, and we are not a party to any agreement you reach with a partner. Commission rates, reserves, insurance, shipping and every other term are matters between you and that business. We do not verify or guarantee any partner's fees, conduct, solvency or outcome, and you should carry out your own checks before consigning anything of value.

6.4 Withdrawing. You can withdraw either consent at any time by emailing privacy@estimonia.com or contacting us. We will stop sharing your details and ask any partner who has already received them to delete their copy. Withdrawal does not undo introductions already made.

6.5 Directory partners. Businesses listed in our directory are subject to separate partner terms. Appearing in the directory does not imply endorsement by Estimonia, and a paid featured placement is marked as such.

6A. Trade Memberships

This section applies only to auction houses, dealers and other businesses holding an Estimonia for Dealers membership. It does not apply to people using the valuation tool.

6A.1 What the membership is. A membership is a subscription giving one named user access to a software dashboard: a feed of items whose owners have consented to trade visibility, filters, saved searches and alerts. It is licensed access to software and data, billed at a flat recurring price. It is not a purchase of leads, a brokerage service, or an agency appointment.

6A.2 One login. A membership covers a single user. Credentials must not be shared, resold or used by more than one person.

6A.3 Vetting. Memberships are reviewed before activation because owners are told their items are shown to vetted businesses. We may decline or withdraw a membership at our discretion, refunding any unused period.

6A.4 What you may do with the data. You may use what you see to decide whether to seek an introduction. You may not copy, export, scrape, republish or resell it, use it to contact owners by any other route, or use it to train a model. Owners consented to vetted members viewing their items — not to onward distribution.

6A.5 No warranty on valuations. Everything in the dashboard is an automated estimate generated from photographs supplied by owners. Nothing has been inspected, appraised or authenticated by Estimonia. Condition, provenance, authenticity, title and legality of sale remain entirely your responsibility, including any restricted materials.

6A.6 No guarantee of supply or outcome. We do not promise any volume of items, any particular category or region, that an owner will respond, or that any introduction will lead to a consignment or sale. Published volumes are historical and not a forecast.

6A.7 Billing and cancellation. Memberships renew automatically until cancelled. Cancel at any time from the panel or by contacting us; access continues to the end of the period already paid for and you are not billed again. Prices exclude VAT, which is applied at checkout. Refunds are governed by our Refund Policy.

6A.8 Suspension. We may suspend or terminate a membership immediately for breach of 6A.2 or 6A.4, or where we believe owner consent is being circumvented. In that case no refund is due for the remaining period.

6B. Paid Products, Prices and Payment

Valuing items with Estimonia is free. We also sell the optional digital products below. Current prices are always shown on our Pricing page and at checkout, and the price shown at checkout is the one you pay.

• Sell-it Plan ($9.99, one-off): a PDF plan for selling one valued item, delivered by email and on a private download page within minutes of payment.
• Estate Valuation Report (One Room $79, Whole House $149, Full Estate $249, one-off): a full report on a set of uploaded photos, unlocked on its private link as soon as payment clears.
• Directory products for businesses: a new directory listing ($99, one-off), the Verified badge ($99, one-off) and Featured placement ($49 per month, renewing monthly until cancelled).
• Trade memberships for dealers and auction houses, as described in section 6A.

6B.1 Merchant of Record. Orders placed on our website are processed by our online reseller Creem (creem.io), who is the Merchant of Record for those orders. Purchases made inside the iOS app are sold by Apple instead (section 6C). Creem handles payment, invoicing, sales tax and VAT, and issues your receipt; its checkout terms also apply to the payment.

6B.2 Delivery and withdrawal. Our products are digital and delivered immediately after payment. By completing checkout you ask us to deliver straight away. If you are a consumer in the EU or UK, you acknowledge that your 14-day right of withdrawal ends once the product has been delivered; this does not affect the refunds we offer under our Refund Policy.

6B.3 Subscriptions. Featured placement and trade memberships renew automatically at the end of each period until cancelled. You can cancel at any time; access continues until the end of the period already paid for.

6B.4 What a paid product is not. A report or plan is guidance built on an AI estimate. It is not a certified appraisal, and it does not guarantee a sale, a price or that any auction house or dealer will accept an item.

6C. In-App Purchases on iOS

6C.1 Who sells. Estimonia Pro, Sell-it Plans and estate reports bought inside the Estimonia iOS app are sold and charged by Apple through your Apple ID, under Apple's Media Services Terms and the Licensed Application End User License Agreement, together with these Terms.

6C.2 Estimonia Pro. Pro is an auto-renewing subscription, monthly or yearly, that gives unlimited valuations (subject to fair use), up to six photos per item, valuation report PDFs and a collection inventory PDF. The price and period are shown before you subscribe. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period; your Apple ID is charged for renewal within the 24 hours before the period ends. Where a free trial is offered, any unused part of it ends when you subscribe. You can manage or cancel the subscription at any time in your Apple ID settings (Settings → your name → Subscriptions). Deleting your Estimonia account does not cancel a subscription.

6C.3 One-off purchases. Sell-it Plans and estate reports bought in the app are one-time purchases for the item or report they were bought for, delivered in the app (and by email if you give an address). They are tied to the Estimonia account they were bought on.

6C.4 Refunds. Refunds for purchases made in the app are handled by Apple under its policies; request one at reportaproblem.apple.com. Our own Refund Policy applies to purchases made on our website.

7. Intellectual Property Rights

7.1 Your Content

You retain all ownership rights to images and content you upload to Estimonia. By submitting content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process, adapt, publish, and display your content for the purposes of:

• Providing value estimates and app functionality, including sending your photos to third-party AI service providers (such as OpenAI, Anthropic, and Google Gemini) for analysis
• Operating, maintaining, and improving our services

You acknowledge and consent that your photos may be transmitted to and processed by the third-party AI service providers identified in our Privacy Policy. These providers may process your images solely to return analysis results to Estimonia and are governed by their own privacy policies and data processing agreements.

7.2 Our Content

The App, including its design, functionality, code, algorithms, text, graphics, logos, and other content provided by Estimonia, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our express written permission.

8. Prohibited Uses

Our Acceptable Use Policy sets out in full what you may upload and how you may use the Service.

You agree not to use Estimonia to:

• Value or authenticate stolen, counterfeit, or illegal items
• Facilitate fraud, money laundering, or other illegal activities
• Harass, abuse, or harm others
• Violate any applicable laws or regulations
• Interfere with or disrupt the App or its servers
• Collect user data without consent

9. Account Termination and Suspension

We reserve the right to suspend or terminate your access to Estimonia at any time, with or without cause or notice, including if we believe you have violated these Terms. You may also delete your account at any time through the App settings. Upon termination, your right to use the App will immediately cease, and we may delete your account data in accordance with our Privacy Policy.

10. Disclaimers and Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, Estimonia disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or availability of the App or estimates
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding third-party services or content

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTIMONIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. This includes but is not limited to damages resulting from:

• Decisions made based on our estimates (buying, selling, insuring, disposing of items)
• Inaccurate, incomplete, or delayed estimates
• Loss or theft of items
• Technical errors, bugs, or downtime
• Unauthorized access to your account
• Actions of third parties

IN NO EVENT SHALL ESTIMONIA'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST 12 MONTHS (OR $100 IF YOU HAVE NOT PAID US ANYTHING). Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Estimonia, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) content you submit to the App.

13. Third-Party Services and Links

The App may contain links to third-party websites, services, or content. We do not endorse, control, or assume responsibility for any third-party services. Your use of third-party services is at your own risk and subject to their terms and privacy policies.

14. Apple App Store Terms

If you access the App through the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Estimonia only, not with Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with the Apple App Store Terms of Service

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice in the App, updating the "Last updated" date, or sending you an email (if you have provided one). Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through:

Informal Resolution: Before filing a claim, you agree to contact us to attempt to resolve the dispute informally.

Courts: If informal resolution fails, disputes shall be submitted to the competent courts and enforcement offices of İstanbul (Çağlayan), Türkiye.

Consumers: If you use the Service as a consumer, nothing in this section deprives you of the protection of mandatory consumer-protection rules, or of access to the courts or dispute-resolution bodies, of the country where you live. Purchases are processed by Creem as Merchant of Record (see section 6B), and Creem's checkout terms also apply to payment matters.

17. Force Majeure

Estimonia shall not be liable for any failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including acts of God, war, terrorism, pandemics, government actions, natural disasters, internet outages, or failures of third-party services.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published in the App, constitute the entire agreement between you and Estimonia regarding the App and supersede any prior agreements or understandings.
